The Attorney-General and Commissioner for Justice of Ogun State, Mr. Oluwasina Ogungbade, SAN, has addressed ongoing media reports that inaccurately place Ogun State among states challenging the constitutionality of the Economic and Financial Crimes Commission (EFCC) at the Supreme Court.

In a statement released on Monday, Ogungbade expressed concern over what he described as misleading reports, noting that despite prior clarifications, certain media outlets continue to list Ogun State as part of the suit against the EFCC. “We don’t have a suit against the EFCC. We have never filed any action challenging its constitutionality,” Ogungbade stated, emphasizing that the state respects the rights of others to seek judicial recourse but has not joined any lawsuit targeting the EFCC’s legal standing.

Ogun State previously addressed this misrepresentation through a statement from the Special Adviser to the Governor on Media and Strategy, Kayode Akinmade, which affirmed that the constitutionality of both the EFCC and the Independent Corrupt Practices Commission (ICPC) had already been upheld by the Supreme Court. The Ogun State government sees no reason to reopen discussions on the matter.

Ogungbade further clarified that the state’s actual case, SC/CV/912/2024, is directed at nullifying the National Financial Intelligence Unit (NFIU) Guidelines issued in January 2023, which Ogun State argues adversely impact its economic and governance interests, along with those of its local governments. “We are not challenging the constitutionality of the EFCC in this case,” Ogungbade reiterated.

This clarification comes amid reports of multiple states, including Benue and Kogi, involved in Supreme Court actions related to the EFCC. Benue’s Governor even suspended the Attorney-General for joining a related case without approval.
